How the EU AI Act Will Differentiate Your Business in a Post-Truth Era
EU AI Act what it is?
The EU AI Act is a risk-based regulation that governs AI systems to ensure they are safe, lawful, transparent, and trustworthy, with strict obligations for higher-risk uses and significant penalties for non-compliance.
The Act applies to any organisation that:
Develops AI systems (providers),
Uses or deploys AI systems in the EU (deployers),
Imports or distributes AI systems in the EU,
Is located outside the EU but whose AI systems affect people or markets in the EU (extraterritorial effect).
4 level of risks
The EU AI Act classifies AI systems into four risk levels:
Unacceptable risk (banned)
AI practices that threaten fundamental rights, such as:
Social scoring by governments,
Certain forms of biometric surveillance,
Manipulative or exploitative AI.
These are prohibited
High risks AI (Strict obligations)
AI systems used in sensitive areas, including:
Recruitment and HR screening,
Creditworthiness and loan approval,
Education and exams,
Healthcare and medical devices,
Biometric identification,
Access to essential services,
Finance and insurances,
Large model providers ...
High-risk AI must meet extensive compliance requirements.
Limited risks (Transparency)
Examples:
Chatbots,
Emotion recognition,
Deepfakes.
Users must be clearly informed they are interacting with AI or AI-generated content.
Minimal risks
Most AI systems (e.g. AI in games, photo enhancement) remain largely unregulated.
For high-risk systems, organisations must implement:
Risk management and mitigation processes,
High-quality, bias-controlled datasets,
Technical documentation and record-keeping,
Human oversight mechanisms,
Robustness, accuracy, and cybersecurity controls,
Post-market monitoring and incident reporting,
Quality Management Systems (QMS).
EU AI Act implementation timelines
2024–2025: Transitional period, preparation
August 2026: Core obligations become mandatory
Some bans and transparency duties apply earlier
Penalties
Non-compliance can lead to fines of up to:
€35 million, or
5% of global annual turnover, whichever is higher. (for companies with less than 250 people, the fine is whichever is smaller)
